As a result, the client receives:

  • Order of the Director of the Department of Housing and Infrastructure of the Lviv City Council on granting permission to individuals and legal entities to use their own apartments as non-residential.

According to DBN B.2.2-15:2019: a non-residential premises is a premises in the structure of a residential building that does not belong to the housing stock.

The conversion of residential premises into non-residential premises is possible subject to compliance with the applicable norms of the Civil Code, the Civil Code, and the Housing Code. Decisions on transfer are made by local self-government bodies. The list of documents differs in each region. So, for the transfer of residential premises to non-residential premises in the city of Lviv, the following documents must be submitted:

1) application addressed to the director of the housing and infrastructure department;

2) a notarized copy of a document confirming ownership of an apartment (house), the premises of which are planned to be used as non-residential (agreement, certificate, extract from the state registration of ownership);

3) a certified copy of the technical passport for the apartment (house);

4) a certificate in form No. 2 stating that the apartment (house), premises that are planned to be used as non-residential, are vacant (in case of transfer of the entire area of ​​the apartment (house);

5) certificate in form No. 13 from the applicant's place of registration;

6) conclusion of the Department of Historical Environment Protection of the Lviv City Council on the possibility of installing a doorway in the place of a window (if the object is located within the historical area);

7) approval of the organization, institution on the possibility of using the apartment as non-residential for other purposes (in the case when the apartment is located in a departmental building, a building of a housing cooperative or a building of the association of co-owners of an apartment building);

8) consent of the co-owners of common areas of the building (any form) in the absence of a technical possibility to arrange a separate entrance to the apartment (signatures must be certified by the company servicing the housing fund);

9) documents on the ownership (co-ownership) of the applicant and family members of housing for living (the living space for each family member cannot be less than the normative living space for one person established by law);

Documents are submitted to the Administrative Services Center of the Lviv City Council in person (including by a proxy) or by mail.

 

But not every room can be converted into non-residential (shop, salon or office). limitation. There are certain features here, such as:

- only those premises located on the basement and first floors can be converted into non-residential buildings. People should not live or be registered in such premises;

- the transfer of housing into non-housing can be carried out on the condition that the owner (his family) is provided with a living area according to the norm determined by the legislation;

- the residential building must not be recognized as an emergency, an architectural monument, and the premises must not be encumbered by the rights of any persons (not be in lien or under arrest).

- if one of the owners of the premises is a minor child, then permission to transfer to a non-residential fund must also be obtained from the guardianship and guardianship authorities.
